In what way? as in what are the "damages"?
some hypothetical over-looked patent aside, what aspect looks to be a copyright infringement to you? The project is open-source, and AFAIK is based on open-source and publicly available sources. The bigest concern I see is providence (when proving where stuff came from) and proper attribution (for applicable source material's licenses) may be a hassle to prove.

Very true; because apple publishes vast portions of code as copyrighted open-source, they prevent much of the hypothetical competition from the get-go.

Copyrighted open-source makes my head hurt. Sounds like "you can look but cannot touch." Remember when Apple killed off the clones? Just my opinion I think Apple is more interested in selling hardware. We don't go out and buy macOS licenses it comes with the hardware.
